The notice of strike case filed by the Kapisanan Ng Malayang Manggagawa (KMM) against Coca-Cola Femsa Philippines, Inc. has been amicably settled, Director Edgar G. Aquino said today.

The union filed the NOS case with the Regional Conciliation and Mediation Branch –National Capital Region on April 22, 2015 following alleged ULP committed  by the management particularly CBA violation, union busting and diminution of benefits. 

“The NOS stems over the alleged refusal of management to sign its CBA with KMM because of the tug-of-war by the latter and GMA Sales Union concerning the scope of membership of the field sales employees of Las Piñas sales office,” Director Edgar G. Aquino, said.

“Apparently, the field sales employees of the Las Piñas have inadvertently been included in the scope of bargaining unit of the two (2) unions when they re-negotiated their CBAs with management.  The two (2) unions claimed said employees their members,” Aquino, added.

The issue brought management no choice but to hold inabeyance the signing of their CBAs with them. It maintains a neutral stand and wants unions to litigate among themselves the scope of bargaining unit.

The parties agreed to settle on June 18, 2015, after a series of conciliation-mediation conferences presided over by the assigned hearing officer to this NOS case, Conciliator-Mediator Estelita S. Bautista,

The CBA benefits include lump sum of Php 30, 000.00 and signing bonus of Php 10, 000.00, which shall all be released to ten (10) union members as early as June 30, 2015 but not later than July 15, 2015.

The variable incentive improvement pay of Php 500.00 monthly shall also be given to all covered employees retroactive October 01, 2014.

The wage increase and grandfather bonus shall be heldin abeyance until the resolution of the interpleader case between KMM and GMA Sales Union.

The company is engaged in the business of manufacturing non-alcoholic beverages for the domestic market.

Kapisanan Ng Malayang Manggagawa (KMM), a labor organization representing field sales monthly paid employees at sales offices assigned in Regions IV-A & IV-B and the cities of Muntinlupa and Las Piñas of the company for collective bargaining purposes. – LIO RRC
