Manila – Through NTA, a 3rd assistant engineer seaman received his claims after the parties forged a compromise agreement recently, Director Feliciano R. Orihuela, Jr. said.

Mr. Afrio F. Dorde who hails from Iloilo City, received his claims last February 22, 2019 for a total amount of P4,653,000.00 as evidenced by the parties’ Joint Motion to Dismiss with Release of All Rights.

Conciliator-Mediator Esperanza P. Rodriguez who facilitated the settlement said that Mr. Dorde sought assistance last August 07, 2018 for total and permanent disability benefits, medical and transportation reimbursement under the CBA, damages and attorney’s fees against EastGate Maritime Corporation.

According to Conmed Rodriguez, Mr. Dorde suffered an injury on board M/V “FJ STAR” sometime in 2017.

Director Orihuela commended Conmed Rodriguez for facilitating the settlement of the notice to arbitrate.

Notice to Arbitrate is the process introduced under DO 40-03 to operationalize the arbitration clauses in the CBA, which are sometimes ignored by one of the parties.  If the issue are grievable and are initially processed under the grievance procedure but did not proceed to its terminal step, the willing party may file to the NCMB Branch a Notice to Arbitrate to initiate the arbitration proceedings.

Under these schemes, complaints filed at the NCMB Branch are processed thru conciliation as the initial step. If the complaint is not settled despite conciliation-mediation efforts, the same is referred to voluntary arbitration.  Selection of voluntary arbitrator is facilitated by the Branch.
